WMC Makes Their Move.

Urgent Update & Call to Action RE Scott Miller

Hello everyone! We have an update to share on one of our medical freedom and freedom of speech cases involving a medical provider in Clark County. Here is a bit of the back story as a reminder.

Scott Miller was a practicing Physician’s Assistant in Washougal, Washington. Mr. Miller had his license immediately suspended on a “temporary” basis in Fall 2021. His license has been suspended since that time. In August 2022, Mr. Miller had a 5-day administrative hearing before the Washington Medical Commission’s panel of four members. The outcome of the hearing was that Mr. Miller’s license was suspended until he complied with the restrictions and conditions the panel placed on his license. One of the conditions was to enter into a mental/psychological evaluation center to demonstrate that he is fit to practice medicine. What Mr. Miller is “guilty” of is saving lives by treating COVID-19 early with Ivermectin and advocating for such treatment.

SMF appealed the WMC’s Order challenging the imposition of psychological evaluation prior to the reinstatement of Miller’s license. The State can require such an evaluation only if it provides notice and a hearing to determine whether the evaluation is a proper punishment. In Mr. Miller’s case, the first time the issue was offered/suggested was when the Assistant Attorney General representing the WMC offered that such treatment would be an appropriate punishment. Mr. Miller was not given an opportunity to challenge the punishment, so we appealed. SMF and the State have briefed the issue of whether the punishment requires special notice and a special hearing. A hearing on this question is scheduled for 11/21 at 9 AM in Clark County Superior Court before Judge Sheldrick. The hearing is open to the public and will be held at 1200 Franklin Street, Vancouver. We were informed by one of the WMC’s attorneys on Friday 11/17/23 that Mr. Miller’s license had permanently been revoked. We don’t know how that will impact this hearing, but all are welcome to attend to show support of Mr. Miller. As this is newly unfolding we ask for your continued prayer and financial support.
