Petition for Temporary Restraining Order
1705 Amended Petition: On March 23, 2022, Governor Jay Inslee signed House Bill 1705 radically altering and expanding Washington’s statutes pertaining to unserialized or untraceable firearms. HB1705 unconstitutionally and categorically bans, under severe monetary and confinement penalties, the manufacture, sale, transfer, purchase, transport, receipt of, and even possession of untraceable firearms. These bans are a broad attack on Washington’s Constitution and its people. On March 16, 2023, Silent Majority Foundation filed an Amended Petition for Declaratory and Injunctive Relief requesting the Court enter an injunction against the implementation of the challenged sections of RCW 9.41.190 as detailed in our Amended Complaint. This filing also requests the Court to grant Declaratory Judgment declaring the challenged laws invalid as they impair individuals’ right to bear arms and violate the right to due process.
1705 Motion for Preliminary Injunction: On March 20, 2023, Silent Majority Foundation also filed Petitioner’s Motion for Preliminary Injunction for HB1705 and is scheduled for hearing on this matter on March 31, 2023 at 9:00AM in Stevens County, WA. In this Motion, Silent Majority Foundation states that with the imposition of the requirement by HB1705 that all firearms now bear a serial number, Washington citizens may only bear arms with the permission and approval of the state. While the State argues that those who want unserialized guns only want them for the implementation of a crime and try to sway the Court and the people to believe this is to help the people of the State of Washington, one could argue that some of the scariest words to hear are “I’m from the Government and I’m here to help you”. The simple fact is the lack of a serial number does not make a weapon more dangerous, does not make the weapon more likely to fall into the hands of children, nor does it alter the functionality of the weapon.
