Hello everyone! We wanted to provide an update on our Washington v. Guardian Arms LLC lawsuit. Before we do that, here is a quick recap of this case:
Back in April 2023, Silent Majority Foundation filed a state lawsuit challenging the effort of Governor Inslee, Attorney General Ferguson, and the state legislature to impair the fundamental constitutional right of Washington citizens to bear arms in self-defense by passing SHB1240. At that time we immediately sought an emergency temporary restraining order in Grant County Superior Court, which is home to petitioners Guardian Arms LLC, Millard Sales, LLC, two local gun stores, individuals Michael McKee, Edgar Salazar, Paul Hill, Ted Hile, Brina Yearout, Nathan Poplawski, and Jaxon Holman, and SMF, which is asserting organizational standing on behalf of its members and donors.
After the state moved our case to Thurston County, they then denied our Temporary Restraining Order. For those who want to dive in further on this, Pete Serrano provides some excellent information below on what took place at this juncture.
In February 2024, we were denied a Direct Discretionary Review which we requested on the basis of the unconstitutionality of the law. Currently, this case is in discovery and the state has requested expert declarations. These cases are lengthy and expensive but are well worth it to protect our freedoms for generations to come. Thomas Jefferson was right on the money when he stated “the price of liberty is eternal vigilance.”
As we move forward with this case and two other 2A cases, we have an urgent request. Judges are telling SMF and our clients that we need expert testimony to support our claims against the State for violating your Second Amendment rights. To regain these rights and to build the record before these courts, we need the best second amendment experts. Your donation ensures we can hire these experts!
