Big WIN but it’s not over yet! Hello SMF family! We wanted to give you an update on our WMC v. Dr. Renata Moon case. Here is quick rundown of what Dr. Moon has been facing.
Dr. Moon testified at a public hearing entitled “Covid-19 Vaccines: What They Are, How They Work, and Possible Causes of Injuries” held by a US Senator in Washington DC in December 2022. In July 2023, Washington State’s Elson S. Floyd College of Medicine reported Dr. Moon’s public testimony to The Washington Medical Commission. The Washington Medical Commission then began investigating Dr. Moon’s medical license for alleged “unprofessional conduct” for voicing concern about the dangers of the Covid-19 shots at this senate hearing. The current investigation by the Washington Medical Commission is frivolous, based on unsound policy and persecutes a physician simply for speaking.
This investigation is an attempt by the Washington Medical Commission to regulate Dr. Moon’s rights of petition, assembly, and speech, and to chill these first amendment rights and those of other medical professionals. A medical professional is not required to agree with any government agency, including the Washington Medical Commission. A medical professional has the obligation to put the well-being of his or her patients before any government-imposed orthodoxy or narrative. A medical professional has the right to gather with other medical professionals and petition the government regarding issues of public interest. In addition, medical ethics dictates that a medical professional has the obligation to speak out when there is a concern that a medical product, which is being used widely and indiscriminately, poses potential risks or where questions arise about its safety. Such debate provides a healthy check and balance on the practice of medicine and promotes the primary responsibility to first do no harm.
On January 26, 2024, SMF received a letter from the Washington Medical Commission explaining that their investigation was complete and the case closed because Dr. Moon’s “(Washington state) license is expired and she has moved out of the state.” In closing, they made sure to thank Dr. Moon for her cooperation and assistance in the “joint effort of patient safety.” The irony in that closing statement. This is a BIG WIN for Dr. Moon, SMF, medical freedom and freedom of speech! While we see this move as a cop out, it proves that the WMC likely knows they really have no grounds in which to move forward. Backing out is the only option when there is no legal standing to even be investigating Dr. Moon. Dr. Moon’s speech is protected under the First Amendment of the United States Constitution.
Without doctors having the ability to speak about these policies, consider different options, and debate opposing viewpoints, individuals seeking medical treatment cannot be assured that the best measures are employed in their care. Nor can the people have confidence that the government is doing its most important job--protecting the rights of a free people. After all, open debate is the bulwark of a free society. Richmond Newspapers v. Virginia, 448 U.S. 555, 587 n.3, 100 S. Ct. 2814, 2833, 65 L.Ed.2d 973, 996 (1980) (quoting Saxbe v. Wash. Post Co., 417 U.S. 843, 862-63, 94 S. Ct. 2811, 2821, 41 L.Ed.2d 514, 527 (1974)). It is only through the sieve of open and public debate that truth is realized in society, and the best debate for this purpose is a debate amongst experts in the field. Thus, limitations on the debate of health policies is not a compelling government interest.

While SMF was able to successfully assist Dr. Moon in stopping the WMC investigation of her terminated license, Dr. Moon and SMF remain actively engaged in the battle against the WMC’s overreach against our medical professionals. SMF will continue its lawsuit against the WMC for its adoption of the COVID-19 Misinformation Position Statement, and we will continue to assist Dr. Moon in holding Washington State University accountable for not renewing her teaching position after her testimony at Senator Johnson’s COVID hearing went viral. Rest assured, a VICTORY today will not have SMF or Dr. Moon resting on in this critical work. Thank you for your continued support in this important case!
